RULES FOR PURCHASE AND SALE OF GOODS

1. General provisions
1.1. These rules for the purchase and sale of goods (hereinafter - the Rules) are a binding legal document for the Buyer and UAB "Fratribus", which sets out the rights and obligations of the Parties, the conditions and procedures for purchasing, paying for, delivering and returning goods, as well as other provisions related to the purchase and sale of goods in the online store Fratribus.eu.
These Rules are prepared in accordance with the Civil Code of the Republic of Lithuania, the Law on the Protection of Consumer Rights, the Law on the Sale of Goods and provision of services when contracts are concluded using means of communication, the rules of Retail trade, the rules of return and exchange of items.
1.2. The Buyer agrees with these Rules when he ticks the active window "I agree with the Rules and Privacy Policy", which appears after the Buyer selects a product, puts it in the "shopping cart" and decides to continue shopping.
1.3. The Seller has the right to change, supplement, amend the rules, taking into account the requirements established by the legal acts of the Republic of Lithuania. Buyers are informed about any changes, corrections or additions to the online store Fratribus.eu by sending a newsletter (information message) to the e-mail they specified.
1.4. Only:
1.4.1 have the right to buy goods in the online store Fratribus.eu. able natural persons, i.e. i.e. persons who have reached the age of majority, whose capacity is not limited by court order;
1.4.2. minors between the ages of fourteen and eighteen, only with the consent of their parents or guardians, except in cases where they dispose of their income independently;
1.5. By agreeing to the Rules, the buyer confirms that, based on clause 1.4 of these Rules, he has the right to buy goods in the online store Fratribus.eu.

2. Protection of personal data
2.1. Before making a purchase in the Fratribus.eu online store, the Buyer must provide his/her personal data (name, surname, delivery address, telephone number), which are necessary for the purchase, delivery and payment of the goods.

2.2. By agreeing to these Rules, the Buyer agrees that the Seller will process his personal data, provided in the registration form, for the purpose of fulfilling the Purchase-Sale Agreement.
2.3. By agreeing to these Rules, the buyer agrees that information messages necessary for ordering, payment and delivery of goods will be sent to the e-mail address specified by him.
2.4. In the questionnaire that the Buyer fills out in order to purchase the product, the Buyer can choose if he wants to be sent messages or offers from the Seller. If the Buyer does not wish, the Seller will not use the Buyer's personal data for marketing purposes and will not send the Buyer advertising or informational messages, except for those necessary to fulfill the order submitted by the Buyer.
2.5. The Seller undertakes not to disclose the Buyer's personal data to third parties, with the exception of the Seller's partners providing goods delivery or other services related to the proper fulfillment of the Buyer's order. In all other cases, the Buyer's personal data may be disclosed to third parties only in accordance with the procedure provided by the legal acts of the Republic of Lithuania.

3. Conclusion of the purchase-sale contract
3.1. The contract between the Buyer and the Seller is considered concluded from the moment when the Buyer, after choosing the product(s) to be purchased and creating a shopping cart (hereinafter referred to as the Shopping Cart), having familiarized himself with the Rules and specifying all the necessary data, clicks the "CONTINUE" button .
3.2. Upon conclusion of the Purchase - Sale Agreement, the range of goods, their quantity, price, delivery time and other conditions specified during the execution of the Buyer's order are binding on both the Buyer and the Seller and can only be changed in accordance with the procedure set forth in these Rules.
3.3. Purchase and sale contracts are registered and stored in the Fratribus.eu database.

4. Buyer's rights
4.1. The buyer has the right to purchase goods in the online store Fratribus.eu in accordance with these Rules.
4.2. The buyer has the right to withdraw from the contract for the purchase and sale of goods concluded with the online store Fratribus.eu by notifying the Seller in writing (by e-mail, indicating the desired return of the advance payment and the order number) no later than as within 14 (fourteen) days from the day of delivery of the goods. In other cases, the buyer will not get the advance back.
4.3. The Buyer's right to refuse the contract of sale of goods discussed in point 4.2 is implemented in accordance with point 7 of part 1 of Article 6.2287 of the Civil Code.
4.4. The Buyer can exercise the Buyer's right discussed in point 4.2 only if the product has not been damaged or has not substantially changed its appearance, as well as if it has not been used.
Despite the fact that in certain cases the Buyer cannot cancel, cancel or adjust the ordered basket of Goods , the Buyer retains the right to withdraw from the contract and return the Goods in accordance with the procedure set forth in these Rules.

5. Seller's rights
5.1. If the Buyer tries in any way to harm the work of the online store, data security or violates other obligations of the Buyer mentioned in point 6, then the Seller has the right to cancel the Buyer's registration or otherwise limit the ability to use the online store Fratribus.eu
5.3 Promotion periods and discounts e-mail store and physical stores may vary.

6. Obligations of the buyer
6.1. The buyer must pay for the purchased goods and accept them in accordance with the procedure provided for in these Rules.
6.2. If the Buyer, during the delivery of the goods, refuses to accept the goods without good reasons, the Buyer must cover the costs of returning the goods to the Seller.
6.3. The buyer undertakes to protect and not transfer to third parties his login data to the online store Fratribus.eu. If the Buyer loses his login data, he must immediately inform Fratribus.eu. Fratribus.eu is not responsible for the actions of third parties after using the Buyer's login data until the moment of notification and the opportunity for the online store administrator to change the Buyer's login data. In this case, Fratribus.eu has the right to consider that the actions in the online store were performed by the Buyer.
6.4. Buyers of the online store Fratribus.eu must comply with these Terms and Conditions, clearly indicated in the information sections of the online store, and must not violate the laws of the Republic of Lithuania.

7. Obligations of the seller
7.1. The seller undertakes to make it possible to use the services of the online store, the operating conditions of which are determined by these Rules and other conditions published in the online store Fratribus.eu.
7.2. The Seller undertakes to deliver the goods purchased by the Buyer to the specified address based on the conditions set by these Rules.
7.3. The Seller undertakes to respect the Buyer's privacy right to his personal information.
7.4. In the event of unforeseen circumstances, when due to unforeseen circumstances, the Seller cannot deliver the goods purchased at the Fratribus.eu online store, the Seller has the right to terminate the purchase-sale agreement, having previously informed the buyer. The Seller can offer a similar product, if the Buyer refuses, the Seller undertakes to return the money paid within 10 (ten) working days.
7.5. After the Buyer exercises the right provided for in Clause 4.2 of the Rules and if the condition stipulated in Clause 4.4 of the Rules is met, the Seller undertakes to return the money paid to the Buyer within 14 (fourteen) days from the day of receipt of the returned goods. The money paid for the initial delivery of the goods to the Buyer is not refundable.

9. Procedure and terms of payment for goods
9.1. The buyer pays for the purchased goods through the payment partner system paysera.lt;
9.2. The buyer, when paying 9.1. in the manner discussed in point, undertakes to pay for the services immediately. A service contract will be formed only after it has been paid.
9.3. If the Buyer does not pay for the purchased goods for more than 3 (three) working days, it is considered that the Buyer has abandoned the sales contract (Article 6.2285paragraph 2 of the Civil Code).

12. Gift vouchers
12.1. The seller offers two ways to purchase the Gift Coupon - in a physical store and in the online store Fratribus.eu
12.2. A gift coupon purchased in a physical store can ONLY be paid for in a physical store.
12.3. Gift voucher purchased by e-mail in the Fratribus.eu  shop, you can ONLY pay at Fratribus.eu 12.4. Gift vouchers cannot be returned or exchanged for cash.

13. Exchange of information
13.1. The Seller communicates with the Buyer using the e-mail provided in the registration form. e-mail address or phone number, and the Buyer can use all communication channels indicated in the "CONTACTS" section of the Fratribus.eu website.

14. Liability
14.1. The buyer is fully responsible for the correctness of the data provided in the registration form. If the Buyer provides inaccurate data in the registration form, the Seller is not responsible for the resulting consequences and acquires the right to demand compensation for the direct losses suffered by the Buyer.
14.2. The buyer is fully responsible for his actions performed after registering at the online store Fratribus.eu
14.3. The buyer is responsible for the security of his registration data. If the registration data is used by a third party, he will be considered a Buyer.
14.4. The Seller is released from any responsibility in all cases where losses occur due to the fact that the Buyer, regardless of the Seller's recommendations and his obligations, did not familiarize himself with these Rules, although he was given such an opportunity.
14.5. In the event of damage, the guilty party compensates the other party for the losses incurred in accordance with the procedure and grounds established by the legal acts of the Republic of Lithuania.

15. Marketing measures applied by the Seller
15.1. The seller can carry out various types of promotions, change their terms and terminate them at any time.

16. Final Provisions
16.1. Fratribus.eu reserves the right to suspend, at its own discretion, fill in, change these Rules and other documents related to the Rules. Additions or changes to the rules take effect from the date of their publication.
16.2. If the Buyer does not agree with the new edition of the Rules, partial additions, changes, the Buyer has the right to refuse them, provided that the Buyer loses the right to use the services of the online store.
16.3. These Rules are drawn up in accordance with the legal acts of the Republic of Lithuania.
16.4. Relations arising on the basis of these Rules shall be governed by the law of the Republic of Lithuania.
16.5. All disagreements arising from the implementation of these Rules shall be resolved through negotiations. If an agreement cannot be reached, disputes are resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
16.6. The parties are released from the performance of their obligations under these Rules if their performance is impossible due to force majeure circumstances.
